Alternatives for EBT & EFRB's For Corporate Clients
Loans have historically been a convenient and robust technique to provide low-tax benefits from many trust structures. However, following recent legislative changes (the disguised remuneration rules), low-cost loans are no longer available in the same way.
We have an alternative to loans and provides a low tax solution to clients. The new legislation is aimed specifically at loan arrangements. The product we can provide does not try to circumvent the new legislation, and Patrick Way (tax counsel) has confirmed that this product is not tax avoidance.
The product is caught by the new rules, and the legislation tells us how to tax the steps involved. However the resulting tax is very low when compared to the benefit derived from the transactions. Once the trades have successfully completed, the trust can be closed down. There are no on-going BiK charges or trustee fees with this strategy. The product can also be used to repay existing loans.
The disguised remuneration rules have not affected the establishment of an EBT by the sponsoring employer, which is a common technique used to obtain a CT deduction from the profits of a trading company.
